1. Agreement to Terms

These Terms of Service (“Terms”) govern your access to and use of the services provided by Precision Data Acquisition Inc., operating as CCD Astrophotography, including our website, remote telescope access, and data set shop (collectively, the “Services”). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree, you may not use our Services.

2. Description of Services

We provide two primary services:

  • Remote Telescope Access: Booking and control of robotic, CCD-equipped astronomical telescopes.

  • Data Set Shop: Purchase of pre-acquired, calibrated astronomical data sets for download.

3. Account Registration & Security

To use certain Services, you must create an account. You agree to:

  • Provide accurate and complete registration information.

  • Maintain the security of your password and accept all risks of unauthorized access.

  • Notify us immediately of any breach of security.

  • Be responsible for all activities conducted through your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Financial Terms

  • Pricing: All prices are listed in US Dollars and are subject to change. Taxes are not included unless specified.

  • Payment: Payment is due at the time of booking or purchase. We use third-party payment processors.

  • Refund Policy: Telescope time is a perishable resource. Refunds are not provided for clear weather losses if our service was technically operational. Data set purchases are non-refundable digital products. Credits or rescheduling may be offered at our sole discretion for significant technical failures on our part.

5. Acceptable Use of Telescope Services

You agree NOT to use our telescope systems to:

  • Observe targets that may damage equipment (e.g., too close to the Sun).

  • Violate any laws, regulations, or third-party rights.

  • Transmit any malicious code or interfere with system operation.

  • Use the system for any purpose other than legitimate astronomical observation.

You are solely responsible for planning your observations, including target visibility and exposure parameters.

6. Intellectual Property Rights

  • Our Property: All software, website content, telescope control systems, and the underlying technology are our exclusive property or licensed to us.

  • Data Licensing: This is a critical section. Please review it carefully.

    • For Purchased Data Sets: Upon purchase, we grant you a limited, non-exclusive, non-transferable, worldwide license to use the data for personal, educational, or non-commercial projects. You must provide attribution in the format: “Data: CCD Astrophotography / Precision Data Acquisition Inc.”

    • For Commercial Use: Using our data (from telescope access or data sets) for any commercial purpose—including selling prints, using in advertisements, films, or software training—requires a separate Commercial Use License. Contact us for terms and pricing.

    • Prohibitions: You may NOT resell, redistribute, sublicense, or make the raw data publicly available for download. You may NOT use data to train machine learning/AI models without a specific agreement.

7. User-Generated Content

If you submit processed images or content to us (e.g., for a gallery), you grant us a non-exclusive license to display, modify, and use it for promotional purposes.

8. Disclaimer of Warranties & Limitation of Liability

  • Services “As Is”: Our Services are provided on an “as is” and “as available” basis. We do not guarantee specific scientific results, data quality for a particular purpose, or uninterrupted access.

  • No Liability for Consequential Damages: To the fullest extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or observation time, arising from your use of the Services.

  • Total Liability Cap: Our total liability for any claim related to the Services is limited to the amount you paid us in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold us harmless from any claims, damages, or losses arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

10. Termination

We may terminate or suspend your access to the Services immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to our systems or other users.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Colorado, USA, without regard to its conflict of law principles. Any disputes shall be resolved in the state or federal courts located in Douglas County, Colorado.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or a prominent website notice. Your continued use of the Services constitutes acceptance of the new Terms.
