Data Licensing Agreement

Precision Data Acquisition Inc. > Data Licensing Agreement

This Data Licensing Agreement (“DLA”) specifies the terms under which you may use data products purchased or obtained from Precision Data Acquisition Inc. (“Licensor”). This DLA is incorporated into our Terms of Service.

1. Definitions

  • “Data” or “Data Product”: The calibrated FITS files, associated calibration frames, and metadata delivered by Licensor.

  • “Processed Image”: Any visual representation (e.g., JPEG, PNG, TIFF) you create from the Data.

  • “Non-Commercial Use”: Use for personal enjoyment, private study, scholarship, academic research, or educational instruction within a non-profit institution.

  • “Commercial Use”: Any use aimed at monetary gain, including selling prints, use in advertising, media, software, or for-profit research.

2. Grant of License

Upon valid purchase or acquisition, Licensor grants you a non-exclusive, non-transferable, non-sublicensable, worldwide license to use the Data subject to the restrictions below.

3. Permitted Uses (Standard License)

  • Attribution Required: For any public display of a Processed Image, you must credit: “Data: CCD Astrophotography / Precision Data Acquisition Inc.”

  • Non-Commercial Use: You may use the Data and create Processed Images for Non-Commercial Use.

  • Academic/Research Publication: You may use the Data in academic papers, theses, and conference presentations with proper attribution.

4. Restricted & Prohibited Uses (Standard License)

You may NOT:

  • Redistribute, resell, lease, or sublicense the raw or calibrated Data to any third party.

  • Make the Data available for public download in its original or minimally processed form.

  • Use the Data for Commercial Use without a separate Commercial License.

  • Use the Data to train artificial intelligence, machine learning models, or neural networks.

  • Use the Data in a manner that is fraudulent, defamatory, or illegal.

5. Commercial Use License

A Commercial Use License is required for any Commercial Use. This license is granted on a case-by-case basis, subject to a separate fee and written agreement. Please contact us at licensing at our primary domain to inquire.

6. No Warranty

The Data is provided “as is.” Licensor makes no warranties regarding its fitness for your particular purpose, scientific accuracy, or completeness.

7. Termination

This license terminates automatically if you breach any of its terms. Upon termination, you must cease all use of the Data and delete all copies.

8. Governing Law

This DLA is governed by the laws of the State of Colorado, USA.
